PHOTOGRAPHY TERMS AND CONDITIONS
1. PAYMENT TERMS:
Deposit Requirement: A 50% deposit is required to reserve your session date. This deposit is non-refundable.
Remaining Balance: The remaining balance of the session fee is due on the day of the session.
Payment Methods: A deposit is required via bank transfer or UPI. The remaining balance can be paid either online or in cash. Please note that checks are not accepted.
2. CANCELLATION/POSTPONEMENT:
Rescheduling Policy: If you need to reschedule, please provide at least 24 hours' notice. The deposit can be applied to the new date. If rescheduling occurs within 24 hours of the session, a fee of ₹3000 will be charged.
3. NON-REFUNDABLE PAYMENTS:
Payments are non-refundable in the event of cancellation or postponement. Refunds, rescheduling, or compensation will not be provided for unreasonable claims of dissatisfaction with the work. Priyanka Modh Photography® maintains full discretion over the quality of work and deliverables, ensuring the best possible outcome while thoughtfully addressing client feedback.
4. COOPERATION/NO SHOWS:
Client Responsibility: It is the client’s responsibility to ensure that all individuals arrive on time and are prepared. The photographer is not responsible for poor performance due to uncooperative individuals.
No Shows: If the client or key individuals fail to appear at the scheduled session, the deposit is non-refundable.
5. SUBJECTS:
Client Control: The client is responsible for managing and ensuring the cooperation of all additional subjects (e.g., siblings or family members) during the session. This helps create a calm environment, especially for newborn or baby sessions.
Baby's Area: The client must ensure that no additional subjects disturb the baby’s immediate area during the session to maintain safety and quality.
6. FAILURE TO PERFORM:
Unforeseen Circumstances: If the photographer is unable to perform due to illness, emergency, or any situation beyond control (e.g., fire, accident, weather), both parties will make every effort to reschedule the session.
Technological Failures: In case of technical failures (e.g., camera, lights malfunction or damaged files), liability is limited to rescheduling as agreed upon with the client.
7. DURING A SESSION:
Attendance: Only the baby’s parents are allowed in the studio unless prior approval has been obtained. Friends and relatives are not permitted. Sessions will be canceled if more than two adults are present without approval.
Health and Safety: The photographer reserves the right to cancel or reschedule the session if any health or safety concerns arise.
8. PHOTOGRAPHY AND VIDEO DURING THE SESSION:
No Personal Equipment: To maintain quality and consistency, clients are not allowed to use personal cameras, mobile phone cameras, or camcorders during any studio or on-location sessions.
9. EDITING PROCESS:
Standard Editing: All photographs will undergo standard editing, including retouching, exposure correction, color correction, and cropping.
Exclusions: Complex retouching (e.g., hair color changes, extreme scarring, background replacement) is not included.
Editing Style: Photographs will be edited according to the photographer’s style, ensuring a cohesive look for your collection.
Timeline for Edited Photographs: Edited photographs will be ready within 20-25 days if clients provide their selection within 3 days of receiving the proofs. Delays in selection may result in delayed delivery.
10. USAGE LICENSE AND COPYRIGHT:
Copyright Protection: All photographs are protected under the Copyright Act of 1957 in India. The photographer holds exclusive rights to the images.
Client Authorization: The client and their spouse must have the authority to use the likeness of individuals in the portraits.
Limited License: Clients receive a limited, non-exclusive license to use the photos for personal purposes only. Copyright notices must remain intact.
Ownership: The photographer retains ownership and copyright of all images for portfolio and promotional use.
11. LICENSING AND OWNERSHIP OPTIONS:
Licensing Option (Included in the Package): Grants the right to use photos for personal needs while the photographer retains ownership.
Privacy Policy (No Upload) Option: If clients prefer not to have their photos shared online, they can purchase a Privacy Policy for the photographs for an additional charge. This option is available with any package.
An additional payment is required at the time of booking.
12. LOGO POLICY:
Print Photos: Photos for print will be provided without logos.
Online Sharing: Photos shared online will include the photographer’s logo, and the position cannot be changed.
Watermarked Photos: In-session low-resolution photos will have a watermark, and its position is fixed and cannot be altered.
13. STORAGE OF DIGITAL FILES AND PRINTS:
File Deletion: The photographer reserves the right to delete all raw files or images after 10 days from the session date.
Client Responsibility: After receiving purchased images, the client is responsible for storing them. Please make multiple copies on your computer, cloud, or other storage.
14. LIMIT OF LIABILITY:
Care and Responsibility: The photographer takes great care in handling and retouching digital captures. If originals are lost, stolen, or damaged beyond control, liability is limited to rescheduling the session at no extra cost.
Quality of Prints: If clients choose to print images through a personal lab, the photographer cannot guarantee print quality and is not liable for any claims related to defects.
Injury Disclaimer: The photographer is not responsible for any injuries incurred during the session. Clients are responsible for their children and themselves, releasing the photographer from any claims.

Disputes or Complaints: Please communicate any disputes or complaints via email only.
If you have any concerns or feel disappointed, we encourage you to reach out to us via email. We truly value the chance to address genuine issues and welcome respectful, constructive feedback.
However, requests or comments that undervalue our work or ask for complimentary(free) additional photographs or prints will not be accommodated.
